2.1. Through the Website (Contact Form)
If you decide to contact us for software development services, we collect:
Name: To address you personally.
Email: To respond to your technical or commercial inquiry.
Message: The content of your request to evaluate the complexity of the project (according to Clause 1.3 of our T&C).
2.2. Waitlist for FocusApp iOS:
To manage interest in our iOS version of our product FocusApp, we use third-party forms (Tally.so) on the product’s landing page. When registering, we collect:
Email: Processed through our messaging infrastructure to send you updates and registration confirmations.
Form Data: Any additional information you voluntarily decide to provide in the Waitlist form.
3. International Transfers and Third Parties
To offer a high-quality service and efficient communication, DVD uses the following service providers, who act as Data Processors and have their own privacy policies:
Resend: Email infrastructure used for sending transactional notifications and technical support.
Tally: Platform used for capturing and managing data in our Waitlist and contact forms.
DVD ensures that these providers comply with high security and data protection standards through their respective Privacy Policies and data processing addendums.
4. Data Retention
Contact Data: Will be kept for the duration of the negotiation or contractual relationship.
Waitlist Data: Will be kept until the user decides to unsubscribe or until the product is launched and the list fulfills its purpose.
5. Specific Use of Contact Data
5.1 Purpose of the Form:
The information sent through the contact form will be used exclusively for professional communication, project estimation, and follow-up of the requested project. DVD will not use these emails for mass marketing campaigns unless the user has separately registered for a mailing list or waitlist.
5.2 Purpose of the Waitlist:
The email provided for the iOS waitlist will be used solely to send updates related to the launch, development status, and exclusive benefits of the product’s release.
6. Your Rights
Under the LOPDP (Ecuador), you have the right to:
Access your personal data.
Rectify inaccurate information.
Delete your data (Right to Be Forgotten), including the deletion of the email used for the waitlist of our FocusApp product.
Object to the use of your data for marketing.

7. Security and Technical Processing
7.1. Security Measures:
We implement industry-standard security protocols. Communication between our website, the application, and our providers (Resend, Tally) is carried out through encrypted channels.
7.2. Encryption at Rest:
The data stored by our infrastructure providers is protected by encryption at rest, limiting access solely to authorized personnel for maintenance and technical support purposes.
7.3. API Management:
The use of Resend’s API allows DVD to manage communications securely without unnecessarily storing email logs on unprotected local servers.
8. Relationship with Third Parties
In accordance with our Terms and Conditions, products developed by DVD include the label “Powered by Digital Vision Development.” This privacy policy covers only the data processing carried out by DVD and not that performed by DVD’s clients within their own products once delivered.

Our website uses minimal analytics tools to understand traffic and improve the user experience (for example, basic visit metrics).
Use of Cookies: When browsing our site, “technical cookies” may be generated, necessary for the operation of Tally’s form or for anonymous analytics.
User Control: You may configure your browser to reject cookies; however, this may affect the functionality of certain interactive elements of the website.
10. Accuracy of Information
In accordance with the Quality Principle of the LOPDP, the user guarantees that the data provided (Name and Email) is accurate, up-to-date, and belongs to them. Digital Vision Development is not responsible for consequences arising from the provision of false emails or third-party emails without authorization.
11. Third-Party Links
Our website may contain links to external platforms such as Facebook, LinkedIn, or TikTok. Digital Vision Development has no control over the privacy policies of these sites. We recommend reviewing the policies of each platform when leaving our domain.
12. Procedure in Case of a Security Breach
In the unlikely event that a security incident affecting the data managed by our providers (Resend or Tally) occurs, DVD commits to:
Notify affected users within a reasonable period after becoming aware of the incident.
Coordinate with providers to mitigate the impact and ensure the integrity of the information as stipulated in Ecuadorian regulations.
