This Privacy Policy describes the manner of collecting, retaining, and processing personal data by David Chamorro ,an individual entrepreneur based in Quito, Ecuador, doing business as Digital Vision Development with RUC 1725881781001,which is the "Controller" of your personal data. This means the Operator determines the purposes and means of collecting, storing, and using your information in connection with the use of the FocusApp mobile application and its associated services.
The protection of privacy and personal data processing is a priority for the Operator. All personal data is treated as strictly confidential and in compliance with the Ecuadorian Organic Law on Protection of Personal Data (LOPDP), the General Data Protection Regulation (EU) 2016/679 (GDPR), and other applicable international standards.
This Privacy Policy supplements and is incorporated by reference into the FocusApp Terms and Conditions. We highly recommend reading these conditions, specially the terms and meanings of the Introduction.
The Operator may modify this policy at any time. Significant changes will be notified via the Application. By using the Service, you consent to the collection and use of information as described herein.
1. General Information and Data Controller
1.1 Legal Basis for Processing: We process your personal data based on the following legal frameworks:
Performance of a Contract: Processing is necessary to provide the Service you requested including but not limited to synchronizing your Pro subscription or enforcing application blocks.
Legitimate Interests: To ensure the security of the Application, prevent "cheating" in the leaderboards, and improve the user interface.
Legal Obligation: To comply with tax and accounting regulations in Ecuador.
Consent: For any other processing activities, such as personalized advertising or participation in public community rankings, where we will request your explicit permission.
1.2 Processing Methods: Personal data is processed both manually ,for support and administrative tasks, and through automated means. Automated processing is essential for the performance of the Service, specifically to verify "The Pact" integrity, process real-time usage statistics locally, and secure internal procedures with our contractual partners.
1.3 Scope of this Policy: This Privacy Policy describes the categories of data we process, the recipients of such data (SDKs and service providers), data retention periods, and the specific rights you hold regarding your personal information.
2. Information we Collect and Use
The Operator adheres to the principle of Data Minimization. We do not collect or store any Personal Information except for the data strictly necessary for the provision of the Service, the synchronization of your progress in the public contest ("The Pact"), and the management of subscriptions.
2.1. Account and Synchronization Data
For the proper functioning of the competition, backup, and synchronization systems, we collect and store the following on our secure servers (Google Firebase):
Identity Information: Email address, username (provided via Google Sign-In), and a unique user identifier (UID).
Public Profile ("The Pact"): If you choose to participate in the community features, your Nickname, Country Flag, Productivity Streak, and the specific list of apps you have blocked will be visible to other Users. This data is used exclusively to foster accountability within the community and is not shared with third parties for commercial purposes.
Subscription Metadata: Information regarding your subscription status (Pro, Trial, or Lifetime). This is processed via RevenueCat and Google Play Billing. The Operator does not have access to, nor stores, your credit card or financial details.
2.2. Local Usage Data
To ensure maximum privacy, the following data is processed strictly on your device and is never sent to our servers or accessible by the Operator:
Usage Statistics: FocusApp uses this permission to identify in real-time which applications are running to trigger blocking overlays.
Display Over Other Apps: Necessary to show the overlays and blocking screens over restricted apps.
Foreground Service: FocusApp runs a persistent service to monitor active "Pacts" and ensure that the Android OS does not terminate the blocking logic during a focus session. This is critical for the stability of the "Pact" integrity.
Biometric Authentication: Used locally in "Parents Mode" to verify the authorized user before modifying restrictions. No biometric data is ever sent to our servers.
Battery Optimization & Exact Alarms: We may request exclusion from battery optimization to prevent the OS from killing the background service and use exact alarms to reset daily limits and trigger scheduled modes (e.g., Night Mode) with precision.
Browsing/App History: Detailed usage times and history are used only to calculate your daily limits and are stored locally. We do not monitor your private content within other apps.
2.3. Device Identifiers and Metrics
For the technical operation and maintenance of the free version, we collect:
Android Advertising ID (AD_ID): Used for ad frequency capping and attribution in the free version.
Technical Logs: Device model, OS version, and crash reports to ensure stability.
2.4. Third-Party Service Providers
We use trusted third-party services to handle specific technical functions. These providers have their own Privacy Policies and comply with international security standards:
Google Play Services: Infrastructure for Android apps.
Google AdMob: Provides advertising services in the free version. AdMob may process advertising identifiers (AD_ID) to provide non-personalized or personalized ads based on your consent.
Firebase: Used for secure user authentication, real-time database storage for "The Pact" streaks, and server-side logic.
Google Analytics: Bug reporting and app performance metrics.
RevenueCat: Our partner for managing and verifying the validity of Pro and Lifetime subscriptions. No payment details (credit cards) are processed or stored by the Operator.
2.5 Transparency in “The Pact” Competition
By voluntarily joining "The Pact," you acknowledge that your productivity progress becomes public within the FocusApp community. This includes displaying your nickname, country flag, and the list of applications you have chosen to block.
Purpose: The goal is to encourage social accountability and "social learning" within the productivity community.
Privacy Guard: Sensitive information, such as your email address, remains strictly confidential and is never shared with the community or third parties.
3. Methods of Personal Data Processing
3.1 Registration and Authentication: We collect personal data exclusively through the Google Sign-In form within the Application. By using this method, the Operator gains access to your email address and public name. It is not possible to create a Profile, participate in "The Pact," or synchronize Pro subscriptions without processing these data.
3.2 Synchronization and Backups: For Users who join "The Pact" or purchase a Pro plan, FocusApp automatically synchronizes your productivity streaks, rank, and blocked app configurations with our secure servers. This data is used solely to provide cross-device backups, maintain community integrity, and for debugging purposes in case of synchronization failure. We do not provide these configurations to third parties.
3.3. Technical Identifiers and Manual Selection
Manual Country Selection: The Country Flag displayed in "The Pact" is a voluntary selection made by the User during the onboarding or profile editing process. The Operator does not use GPS or IP-based geolocation to automatically determine or verify your physical location.
Infrastructure Logs: Our service providers (Google Firebase) may process technical identifiers such as IP addresses and device metadata automatically. This processing is strictly for the purposes of infrastructure security (DDoS protection), service stability, and general usage metrics. This data is not used by the Operator to identify the User's specific geographic location.3.4 Consent and Withdrawal: By providing your data and opting into "The Pact," you acknowledge that your information will be processed as described. You may withdraw your consent at any time by:
Deleting your account from the Application settings.
Requesting data deletion via email at digitalvison.development@gmail.com.
Note: Withdrawal of consent for data processing may result in the inability to use community or synchronization features.
3.5 Statistical Anonymization: We process anonymized statistical information to understand how Users interact with FocusApp (e.g., which blocking modes are most popular). This data cannot be traced back to an individual User and is used for research and development of new wellbeing features.
3.6 Support and Communication: If you contact our support team, we may use the information previously provided in your Profile to resolve your inquiry more efficiently.
3.7 Commercial Communications: You have the right to refuse the processing of your personal data for marketing or commercial purposes at any time. You can opt-out by:
Clicking the "Unsubscribe" link in any automated email.
Sending a direct request to our support email.
This refusal will not affect your ability to use the core features of FocusApp.
4. Data Retention Period
The Operator stores your personal data only for the time necessary to fulfill the purposes for which it was collected. Below is the specific retention schedule for FocusApp,regarding the purpose of processing and its retention period:
Performance of Contract (The Pact & Pro Service): For the entire duration of the User's registration in the Service.
Fulfillment of Legal Obligations (Tax/Audit): For the period prescribed by applicable Ecuadorian regulations.
Protection of Legitimate Interests (Anti-Cheat & Security): Up to a maximum of 3 years from the last active interaction, unless a justified legal need requires a longer period.
Marketing and Commercial Communications: For as long as consent is granted or until the User withdraws consent (Unsubscribe).
Technical Support and User Requests: For the duration of the User's registration or until the specific inquiry is resolved and closed.
Local Usage Data: Stored only locally; it is deleted immediately upon uninstallation or clearing of the application cache.
5. Marketing, Profiling, and Consent Withdrawal
5.1 Voluntary Marketing: If you provide explicit consent to receive personalized marketing communications or push notifications regarding FocusApp updates and "The Pact" challenges, you acknowledge that this consent is voluntary.
5.2 Profiling: For the purpose of improving your productivity experience, we may use automated processing (profiling) to suggest specific Focus Modes based on your usage patterns. This profiling is used strictly within the Application and is not shared with external marketing agencies.
5.3 Withdrawal: You may withdraw your consent at any time:
By clicking the "Unsubscribe" link in our emails.
By disabling "Notifications" in your device settings.

Note: Refusing consent for marketing does not affect your access to the core Service or "The Pact" features.
6. Recipients of Data and International Transfers
6.1 Authorized Recipients: The Operator only discloses your personal data to authorized personnel or contracted data processors (service providers) under strict confidentiality agreements. These recipients include:
IT and Cloud Infrastructure Providers: Google Cloud/Firebase (USA).
Payment Processors: Google Play Billing and RevenueCat (USA).
Advertising Partners: Google AdMob (for free version users).
Public Authorities: We may be legally obliged to transfer certain personal data to law enforcement or other public authorities in Ecuador or elsewhere if required by a valid legal mandate (e.g., preventing fraud or responding to a court order).
6.2 International Transfers: Since FocusApp uses infrastructure located primarily in the United States, your data will be transferred outside of Ecuador. The Operator ensures an adequate level of protection by using Standard Contractual Clauses (SCCs) and ensuring our providers comply with high-security standards (such as SOC 2 or ISO 27001).

7. Third Parties Data
7.1 Scope: This section applies to personal data of individuals who are not direct Users but are employees of business partners, service providers, or other natural persons participating in cooperation with the Operator (e.g., potential future partners, or corporate focus groups using FocusApp).
7.2 Processing Purpose: Any data received from business partners in connection with the performance of a contract will be processed strictly in accordance with the Ecuadorian LOPDP and applicable international laws. The Operator will use this data exclusively to fulfill contractual obligations with said partners.
7.3 Retention for Partners: Data from third parties will be kept for the duration of the contractual relationship and for the period stipulated by special legal regulations.
7.4 Partner’s Obligation: Any business partner providing third-party data to the Operator is obliged to duly inform their employees or customers about the processing of their personal data by FocusApp.
8. Security of Personal Data
8.1 Security Measures: Personal data is secured using technical and organizational means designed to provide complete protection in accordance with the Ecuadorian LOPDP and the GDPR. This includes encryption of data in transit and at rest within the Google Firebase infrastructure.
8.2 Email Confidentiality: Due to the nature of telecommunication networks, the Operator cannot guarantee the 100% confidentiality of emails sent to or received from the Operator, nor verify their absolute authenticity.
8.3 Processing Methods: Personal data is processed electronically by automated means or manually by authorized personnel of the Operator for support purposes. All processing is subject to strict confidentiality obligations.
8.4 Infrastructure Security: Data is stored on secured servers provided by Google Cloud. While we utilize these industry-standard security measures, the operator shall not be held liable for any data loss, corruption, or unauthorized access occurring within Google Cloud's infrastructure.
8.5 Access Control (Google OAuth): Your Profile is accessed exclusively through Google Sign-In. FocusApp does not store or see your Google password. The security of your account relies on your Google credentials. The Operator assumes no liability for the misuse of your Google account or the failure to secure your physical device.
9. Installed Apps Access
9.1 Purpose of Access: To provide its core functionality, such as application blocking, usage statistics, and the "Pact" competition, the Service requires access to the inventory of installed applications on the User’s device.
9.2 Local Usage: On a local level, this inventory is used to allow the User to select which applications to restrict and to monitor their foreground usage in real-time.
9.3 "The Pact" Synchronization: Unlike general inventory access, the Operator only stores and synchronizes the specific list of applications that the User has chosen to block on its servers. This is necessary to display your "Pact" configuration to the community.
9.4 Data Limitation: The Operator does not store, upload, or use the data of the entire inventory (apps that are not blocked or monitored) for any other purpose. No inventory data is sold or provided to third-party marketing agencies.
10. Service Providers and Third Parties
10.1 Purpose of Engagement: We may employ third-party companies and individuals (as detailed in Section 2.4) for the following reasons:
To facilitate and maintain our Service ;
To provide subscription management on our behalf ;
To assist us in analyzing how our Service is performed and used ;
To serve advertisements in the free version.
10.2 Obligations: These third parties have access to your information (which is anonymized whenever possible) only to perform the tasks assigned to them on our behalf. They are strictly obligated under contract not to disclose or use the information for any other purpose.
11. Rights of the User
11.1 Exercise of Rights: In accordance with the Ecuadorian LOPDP and Articles 15 to 21 of the GDPR, you may exercise the following rights at any time:
(i) Right of Access: To obtain confirmation as to whether or not your personal data is being processed and receive a copy of said data.
(ii) Right to Rectification: To have inaccurate or incomplete personal data corrected (e.g., changing your nickname in "The Pact").
(iii) Right to Erasure (Right to be Forgotten): To have your personal data deleted when it is no longer necessary for the purposes for which it was collected.
(iv) Right to Restriction of Processing: To temporarily limit the processing of your data under specific circumstances.
(v) Right to Data Portability: To receive your data in a structured, commonly used, and machine-readable format.
(vi) Right to Object: To stop the processing of your data based on legitimate interests, unless the Operator proves compelling legitimate grounds that override your interests.
(vii) Right to Withdraw Consent: To revoke your consent for data processing (e.g., for marketing or community features) at any time.
11.2 Supervisory Authority: In the event of a breach, you have the right to file a complaint with the Superintendencia de Protección de Datos in Ecuador or your local data protection authority.
12. Data Deletion and Account Termination
12.1 In-App Data Management: Users have the option to manually reset or clear their stored progress (streaks and leaderboard records) within the Application’s settings. Please note: performing a "data reset" only removes the historical activity linked to your profile but does not terminate your account or cancel your active subscription tier.
12.2 Full Account Deletion (Self-Service): FocusApp provides a direct "Delete Account" feature within the Application settings. Executing this function will trigger the following permanent actions:
(i) Authentication Removal: Your user identity and email address will be permanently deleted from Firebase Authentication.
(ii) Database Eradication: All associated metadata, including your UID, productivity streaks, and "The Pact" records, will be erased from our Firestore databases.
(iii) Subscription Disconnection: Your profile will be disconnected from our internal subscription records (RevenueCat). Warning: Deleting your account within the app does not automatically cancel an active subscription in the Google Play Store; you must manage your billing through your Google Account settings.
12.2.1. Loss of Promotional Benefits: By deleting your account, you acknowledge that any "Free Trial" periods granted manually by the Operator (outside of the Google Play Billing system) will be terminated. Re-registering does not guarantee the reinstatement of a previously active trial period.
12.2.2. Lifetime Restoration: While your "Pact" data (streaks) will be permanently lost, Users who purchased a Lifetime Plan can restore their access by using the "Restore Purchases" feature after re-registering, provided they use the same Google Play Store account used for the original purchase.
12.3 Manual Request: If you are unable to access the Application, you may request the permanent deletion of your account and all associated data by sending an explicit email to digitalvison.development@gmail.com. We will process your request and verify your identity within 15 days.
12.4 Identity Verification: To protect your security, the Operator reserves the right to verify the identity of the applicant before complying with any request to exercise the rights mentioned above.
13. Children’s Privacy and "Parents Mode"
13.1 Minimum Age: FocusApp is not directed at children under the age of 13. We do not knowingly collect personal data from children.
13.2 Parents Mode: This feature is a local control mechanism intended for adults to manage their own or their family's device usage. It does not involve the collection or transmission of personal data from children to our servers. If you believe a minor has provided us with personal information, please contact us immediately for deletion.
