These Terms and Conditions were updated on 30/03/26.
1. Introduction
1.1 For the purpose of these Conditions, including any documents incorporated by reference (specifically the Privacy Policy), the terms below shall have the following meaning:
•Application: Refers to the FocusApp mobile application for Android and IOS, through which the Service is provided.
•Operator: Refers to David Chamorro, an independent developer and individual entrepreneur registered in the Republic of Ecuador with RUC 1725881781001, doing business under the commercial name of Digital Vision Development.
•The Pact: Refers to the gamified social community feature where users share their productivity streaks and blocked app lists for accountability.
•Service: Refers to the digital wellbeing tools provided within FocusApp, including but not limited to application blocking, usage monitoring, "The Pact" social features, and special restriction modes.
•User: Means any individual who installs, accesses, or uses the Application.
•Conditions: Mean these Terms of Service / Conditions of Use of FocusApp.
•Profile: Means the User’s account created.
•Privacy Policy: Refers to the separate document describing how we process personal data, which is an integral part of these Conditions:
•Applicable Law:
•Electronic Commerce Law: Refers to the Ley de Comercio Electrónico, Firmas Electrónicas y Mensajes de Datos of Ecuador.
•Civil Code: Refers to the Código Civil of the Republic of Ecuador.
•LOPDP: Refers to the Ley Orgánica de Protección de Datos Personales of Ecuador.
•Intellectual Property: Refers to the Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación (COES) regarding software protection.
1.2 Acceptance of Terms
By accessing or using FocusApp, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you must not use the application or participate in its competitive features.
2. Provided Services and User Login
2.1 Service Scope: The Operator provides the FocusApp Service, designed to enhance the User's digital wellbeing by restricting compulsive application usage. This is achieved through numerous techniques, including but not limited to: timed overlays, strict cooldown periods , daily usage limits, and specialized focus modes.
2.2 Service Modalities: The Operator offers FocusApp under a "Freemium" model with the following tiers:
•Free Version: Includes blocking for up to two (2) applications, contains advertisements, provides access to special modes with specific restrictions, and offers "read-only" access to the Community Leaderboard. Users in this tier cannot actively participate in "The Pact" rankings.
•Pro Subscriptions (Monthly/Annual): Unlocks unlimited application blocking, removes all advertisements, and grants full active participation in "The Pact" and global leaderboards.
•Lifetime Plan: A single one-time payment granting perpetual access to all Pro features for the lifetime of the Application.
2.3 Special Modes and Concessions:
FocusApp currently includes Gym Mode, Night Mode, Party Mode, Parents Mode and Inmersion Mode.
•Party Mode: This is a wellbeing concession. By activating it, the User voluntarily waives their current restrictions for a limited time. The Operator reserves the right to limit the frequency of this mode to prevent habit degradation.
•Parents Mode: Security (PIN/Biometrics) for this mode is managed locally via the device’s security APIs. The Operator does not store these credentials and is not responsible for unauthorized access due to weak device security configurations.
2.4 Registration Method: Registration is conducted exclusively through Google Sign-In (OAuth 2.0). By registering, the User authorizes FocusApp to access basic profile information (email and display name) provided by Google LLC. No manual passwords are created or stored by the Operator. The registration process is conducted online and requires a stable internet connection.
2.4 Account Security and Liability: Users are exclusively responsible for the security and confidentiality of their Google Account used to access FocusApp. The Operator shall not be liable for any unauthorized access to the User's Profile resulting from the User's failure to secure their mobile device or Google credentials. Should the User suspect their account has been compromised, they must immediately secure their Google Account and notify the Operator at digitalvison.development@gmail.com.
2.5 Technical Requirements: The User acknowledges that the Service's effectiveness relies on specific Android system permissions (Usage Stats, Display Over Other Apps, and Foreground Service). The User is responsible for maintaining these permissions active; revoking them will render the Service unable to perform its blocking functions.
3. "The Pact" Community Rules and Anti-Cheat Policy
3.1. Nature of the Competition and Absence of Prizes
Participation in "The Pact" and its associated leaderboards is strictly for motivational, symbolic, and community-building purposes.
•Honor-Based System: The User acknowledges and agrees that the competition is merely for honor, self-improvement, and social accountability.
•No Tangible Rewards: The Operator does not offer, and the User is not entitled to receive, any physical prizes, monetary compensation, gifts, or tangible rewards of any kind for achieving high rankings, maintaining long productivity streaks, or "winning" any community challenge.
•Disclaimer: Achieving a top position on the leaderboard does not create any credit, debt, or obligation on the part of the Operator toward the User.
3.2 Equality of Conditions: Upon joining "The Pact" for the first time, the User’s streak will automatically reset to Day 1. This ensures all competitors start under server-side supervision to prevent local data manipulation.
3.3 Grace Period and Streak Forfeiture: Pro Users have a 24-hour grace period to renew expired subscriptions. If the subscription is not reactivated within this timeframe, the system will automatically reset the productivity streak to 0 days, and the User will be removed from the active competition.
3.4 Anti-Cheat and Integrity: The Operator reserves the right to disqualify, ban, or reset the progress of any User suspected of:
•Using emulators or virtual environments.
•Manipulating system date/time settings.
•Employing external software to falsify productivity metrics.
The Operator’s decision, based on Firebase server logs, is final and non-appealable.
3.5 Technical Error Clause: FocusApp is under continuous development. The Operator reserves the right to modify, pause, or cancel leaderboard rankings or "Pact" challenges at any time if technical bugs, security vulnerabilities, or exploits are detected.
3.6 Username Moderation and Community Standards
The Operator reserves the absolute and unilateral right to moderate, hide, or permanently remove any User from "The Pact" rankings and global leaderboards if their chosen nickname or profile data is deemed, at the Operator’s sole discretion, to be:
(i) Offensive or Obscene: Containing profanity, sexually explicit language, or vulgarities.
(ii) Discriminatory: Promoting hate speech, racism, or harassment against any group or individual based on race, religion, gender, or nationality.
(iii) Controversial or Volatile: Using names that are politically sensitive, inflammatory, or designed to incite conflict within the productivity community.
(iv) Impersonation: Attempting to pose as another person, a public figure, or an official representative of Digital Vision Development.
(v) Infringing: Violating third-party trademarks or intellectual property rights.
3.5.1 Consequences of Violation: Any User found in breach of this clause may have their nickname reset to a generic value (e.g., "User_123"), be temporarily suspended from the ranking, or face a permanent ban from "The Pact" features without prior notice. The Operator’s decision in these matters is final and shall not entitle the User to any form of refund or compensation for Pro subscription fees.
4. Payments, Renewals, and Refunds
4.1 Processing: All financial transactions are processed via Google Play Billing and managed by RevenueCat. The Operator never collects or stores credit card numbers.
4.2 Automatic Renewal: Subscriptions renew automatically unless canceled in the User's Google Play Store settings at least 24 hours before the current period ends.
4.3 Refund Policy: Refunds are governed strictly by Google Play Store Policies. Consistent with Ecuadorian consumer law for digital services, the cancellation of a subscription does not entitle the User to prorated refunds for unused time within a billing cycle.
5.User Rights and Obligations
5.1 General Compliance: In the course of using the Service, the User is obliged to strictly observe these Conditions and all applicable local and international laws.
5.2 Intellectual Property Protection: By using the Service, the User expressly undertakes to:
(i) Fulfill all obligations arising from generally binding laws and regulations regarding intellectual property.
(ii) Refrain from any infringement of the intellectual property rights of the Operator or third parties. This includes, but is not limited to: copying, distributing, modifying, or reverse-engineering the Application’s source code, algorithms, or unique blocking logic.
(iii) Refrain from unauthorized use of any content protected by the Ecuadorian Organic Code of Social Economy of Knowledge, Creativity, and Innovation (COES) or international copyright treaties.
5.3 Trademarks and Visual Assets: The name "FocusApp", the brand "Digital Vision Development", and all logos, graphics, custom icons, animations, videos, and texts displayed through the Service are the exclusive property of the Operator. These assets may not be reproduced, used, published, distributed, or displayed in any commercial or non-commercial context without the prior written consent of the Operator.
5.4 Prohibited Activities: The User shall not use the Service to:
Interfere with or disrupt the integrity or performance of the Service or the data contained therein (including "The Pact" leaderboards).
Attempt to gain unauthorized access to the Service or its related systems or networks.
Scrape or extract data from the Application for the purpose of creating a competing service.
5.5 Reporting Obligations: The User undertakes to inform the Operator without undue delay about any breach of these Conditions. If a User identifies improper behavior, "cheating" in the rankings, or any undesirable content published by another User in "The Pact", they are obliged to notify the Operator immediately by sending an email to digitalvison.development@gmail.com.
5.6 Anti-Reverse Engineering: Any monitoring, interference, or technical analysis of the Application is strictly prohibited. This includes, but is not limited to: decompiling, decoding, reverse engineering, or back-analysis of any software or technical aspect incorporated in FocusApp. Any unauthorized interference may cause significant damage to the Operator, and the Operator reserves the right to claim full compensation for such damages from the User.
5.7 Third-Party Intellectual Property: The Service may integrate or display third-party intellectual property. The User does not acquire any rights regarding trademarks, business names, or logos belonging to the Operator or third parties.
6. Operator’s Liability and Disclaimer of Warranties
6.1 Third-Party Services and Technical Constraints: The Operator is not liable for services supplied by third parties, such as the quality of the Internet connection, telecommunication services, or the performance of the Android Operating System. The User acknowledges that FocusApp operates within the constraints of the Android environment, and its effectiveness may be affected by system updates, "Power Saving" modes, or extreme battery optimizations beyond the Operator’s control.
6.2 "As Is" Provision: The Service is provided on an “as is” and “as available” basis. While the Operator strives for 100% effectiveness, it does not guarantee that the Application will be error-free, uninterrupted, or infalible against all methods of "force-closing" or bypassing restrictions.
6.3 Critical Applications and Emergencies: FocusApp is a voluntary productivity tool. The Operator strictly advises AGAINST blocking essential services, including but not limited to: emergency calls (911/112), instant messaging used for critical communication, GPS navigation, medical/health applications, or mobile banking.
•The User assumes full and exclusive responsibility for the applications they choose to restrict.
•The Operator is not liable if the User remains incommunicated or is unable to perform a critical action due to an active block configured by the User.
6.4 Limitation of Damages: To the maximum extent permitted by the Ecuadorian Civil Code and applicable international law, the Operator is not be liable for:
(i) Economic loss, lost profits, missed flights, missed appointments, or loss of data.
(ii) Any direct, indirect, incidental, or consequential damages resulting from the inability to access a blocked application.
(iii) Any harm or injury arising from the User's intentional decision to restrict their own device access.
6.5 Device and Software Integrity: The Operator is not liable for any damage caused to the User’s electronic devices or other software running on said devices. The installation and use of the Application are performed at the User's own risk.
6.6 Indemnification: The User agrees to indemnify and hold the Operator harmless from any costs, losses, or claims (including legal fees) arising from the User's breach of these Conditions or the violation of any law or third-party rights.
6.7 Suspension of Service: The Operator reserves the right to restrict, modify, or temporarily suspend the Service for maintenance or technical updates without compensation to the User. The Operator is not liable for any loss caused by such suspension.
7. Service Evolution and Technical Instructions
7.1 Modifications to the Interface: The Operator reserves the right to amend or change the Application’s graphic layout, content, features, or technical processes at any time without prior notice. These changes are part of the continuous improvement of the Service.
7.2 Binding Instructions: While using the Service, the User is obliged to observe all technical instructions and prompts provided within the Application interface. Any instruction concerning the technical aspects of the Service (e.g., how to exclude the app from battery optimization) is considered an integral and binding part of these Conditions.
8. Administrative Rights
8.1 Severability Clause: Should any provision of these Conditions be found invalid, illegal, or unenforceable by a competent court, such provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
8.2 Governing Law: These Conditions and all legal relations between the Operator and the User are governed by the laws of the Republic of Ecuador, specifically the Civil Code and the Electronic Commerce Law. In case of conflict, these Conditions shall prevail over any non-mandatory provisions of the Civil Code.
8.3 Set-off and Assignment of Rights:
Set-off: The Operator is entitled to set off any of its claims against the User. The User is not entitled to set off any claims against the Operator.
Transfer of Rights: The User hereby gives express consent for the Operator to assign or transfer its rights and obligations under these Conditions (in whole or in part) to any third party (e.g., in the event of an acquisition or merger). The Operator will inform Users of any such transfer via the Application.
8.4 Severability: If any provision hereof is found to be unenforceable or invalid, it will not affect the validity of the rest of the document. The Operator will replace such provision with a valid one that maintains the original intent and economic effect.
8.5 Unilateral Modifications: The Operator is entitled to change these Conditions unilaterally to reflect technical, legal, or commercial updates. Continued use of the Application after such changes constitutes acceptance of the new Conditions.
8.6 Dispute Resolution: In the event of any dispute, claim, or controversy arising out of or relating to the Service, the parties agree to seek an amicable solution. If no agreement is reached, the parties expressly waive any other jurisdiction and agree to submit to the Judicial Units and Courts of Quito, Ecuador.
8.7 Language: These Conditions may be translated into multiple languages for the convenience of global Users. However, in the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail for legal purposes.
